These terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the terms and conditions set out below. If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.

Waiver

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

Survival

Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

Entire agreement

These Conditions govern our relationship with you. Any changes to these Conditions must be in writing and signed by both parties. In this way, we can avoid any problems surrounding what Morrells Handwriting and you are expected to do. You confirm that, in agreeing to accept the Conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation. Nothing in this Clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions.

Conditions Relating to the Sale of Products to You

This section deals with conditions relating to the sale of products by Morrells Handwriting to you.

No order shall be subject to any other conditions inconsistent with or to modifications of these conditions unless we specifically agree thereto in writing. We shall not be deemed to accept any such conditions nor to waive any of these conditions by falling to object to provisions contained in any purchase order or other communication from the consumer.

Our contract

When you place an order to purchase a product from us, we will send you an e-mail confirming receipt of your order and containing the details of your order and how your product will be delivered.

Acceptance of your order and the creation of a legally binding contract between us will only occur when we send you this email (Order Confirmation). Alternatively, we may decline all or part of your order for any reason, in which case our Order Confirmation email will tell you so.

If for any reason your payment cannot be authorized we invite you to pay by another method. We may use a credit reference agency to verify your details.

Price and Payment

All prices and charges on this site are subject to VAT and carriage and this will clearly indicated before you place your order.

We charge your credit or debit card when we process your order.

If you have paid by cheque, the funds must be cleared into our account prior to any goods being dispatched. In this instance if we owe you a full or partial refund, we will send a refund cheque for the correct amount.

Prices, offers and products are subject to availability and may change; in which case we may offer you an alternative prior to your order confirmation.

We try to keep this site accurate, however if we discover an error in the price or description of a product, we will contact you to ask if you wish to continue with the order or cancel it.

Delivery

Delivery dates are approximate only and not of the essence of the contract.

Unless stated otherwise our delivery is on an overnight basis and the courier delivery service offered operates from Monday to Friday, between 9am and 6pm. Orders received after 1pm cannot be guaranteed for next day delivery.

You shall ensure that having agreed a delivery date, the goods upon arrival shall be received on the same day and signed for as being complete in accordance with the number of cartons listed on the despatch note.

Delivery must be to an address in the United Kingdom, but excluding the Channel Islands and, for some larger items, the Isle of Man, Anglesey, the Isles of Scilly and the Scottish Islands. All deliveries must be signed for except for items sent by post and which are small enough to be put through your letterbox. Please make sure you keep the receipt enclosed with your goods.

Returns procedure

We hope you will be pleased with your purchase. Should you wish to return anything bought from us or cancel your order, we will be happy to refund the product provided it is in fully re-saleable condition. Returns should be made within a reasonable time (7 working days) and in the original, undamaged packaging.

If we find that the product has not been returned to us in a fully re-saleable condition, we reserve the right to refuse a refund on the item, or deduct up to 20% of the original selling price from the refund amount.

Returns can be made either via courier collection for which we may levy a charge or alternatively in person at the Morrells Handwriting headquarters. If you fail to make the goods available for collection then a charge will be deducted from the refund of the goods for any expenses incurred by us.

Complete our online form including: order number, stock number, the reason for the return and whether you want a refund or a replacement.

Refunds policy

We will email you back with further instructions and we will arrange for the courier to come to collect the product you wish to return.

Please note: We will refund the price of the item to the purchaser or exchange the product once it is received by us. A refund of the delivery charge will be given in the instance of incorrect, damaged or faulty goods.

Products we are unable to refund or exchange

No refunds or exchanges are offered for individual items that are surplus to requirements or simply unwanted.

Cancellation

You can cancel your contract at any time either before or up to 7 working days following the day the goods are delivered, in accordance with your statutory rights. You can do this by e-mailing our Customer Service Representatives or call us on 07929737444 between 9am-5pm.

If we find that the product has not been returned to us in fully re-saleable condition, we reserve the right to refuse a refund on the item, or deduct up to 20% of the original selling price from the refund amount.

Non-delivery and loss

We must be notified in writing of the non receipt of any goods by you or your nominated carrier within 3 working days of the invoice date, failing which we shall be under no liability whatsoever to you, who shall nevertheless hold Morrells Handwriting indemnified against any loss arising, or damage suffered, through failure to inform us within the required time limits.

Damage and defect

You must notify us of any alleged defect to the goods within 14 days of actual receipt and thereafter shall be deemed to have accepted the goods in all respects. Any such notice must specify the particular defect and must afford us reasonable opportunity to inspect the goods in question. If the goods are agreed by us to be defective or faulty, we will (at its option) either rectify the defect or fault, or replace any such goods, or credit the invoice value of the goods and such rectification or replacement or credit will be in full satisfaction of any claim by you. Provided that nothing in this clause contained shall operate to limit or restrict the liability of Morrells Handwriting for the death or personal injury caused by the negligence of Morrells Handwriting or its servants.

You shall indemnify and keep at all times fully and effectually indemnified Morrells Handwriting from and against any claims of whatsoever nature brought against us by any third party pursuant to the provisions of the Consumer Protection Act 1987 in respect of the goods or any other goods of which the goods form a part and form and against any costs, damages, expenses or liabilities whatsoever arising there from provided that nothing herein contained shall operate so as to limit or restrict the liability of Morrells Handwriting for death or personal injury caused by the negligence of Morrells Handwriting or its servants.

Force Majeure

If delivery of all or some of the goods is hindered, prevented or delayed by force majeure, Morrells Handwriting shall not be liable for any loss or damage caused thereby and shall have the option to cancel wholly, or in, part, or to suspend, or delay the delivery or deliveries without incurring any liability to you. Morrells Handwriting shall not be required to obtain elsewhere in the market goods with which to replace goods delivery of which has been postponed or cancelled as a result of any of the said events. By force majeure is meant all events or circumstances beyond the control of Morrells Handwriting which by their nature could not reasonably have been foreseen by Morrells Handwriting or, if they could reasonably have been foreseen, are unavoidable or beyond the reasonable control of Morrells Handwriting, and which prevent or hinder the total or partial performance of any obligation under this contract. In the event of cancellation we shall be paid for all goods delivered or work done to that date.

Risk

Risk in the goods shall pass to you when the goods are delivered to you (delivery to a carrier or to any person, firm or company on your behalf shall constitute delivery to you).

Operation of Law

These conditions shall be construed and the right of the party hereto shall be governed by the laws of England. You hereby submit himself to the jurisdiction of the English courts.

These terms and conditions only cover the Morrells Handwriting website. Any other websites to which you link from this site are governed by their own terms and conditions. We accept no responsibility or liability for the content or operation of websites which are not under our control. We are required by law to tell you that sales can be concluded in English only and that no public filing requirements apply.
